Application to Withhold Information Gentlemen:
This is in response to your letter of December 3,
1984, requesting deletion of names and other information which could disclose the identity of persons named in the Office of Investigation report furnished you by our letter dated November 21, 1984.
You requested these deletions be made prior to placement of the report in the NRC Public Document Room in the interest of the personal privacy of the individuals involved.
I have given your request careful consideration.
I understand and appreciate your concern for the personal privacy of individuals.
Moreover, the NRC regulation under which you made this request (10 CFR 2.790(a))
recognizes the need for balancing such interests in nondisclosure against the public interest in disclosure.
Having weighed these interests, and having found no compelling reason for nondisclosure, I have concluded that your request must be denied.
You noted in your letter an understanding that the U.S. Department of Justice has concluded that institution of criminal actions against any of the persons identified in the report is not warranted.
I believe this to be the case since Justice Department officials have advised, among other things, that there is no evidence of criminal intent regarding the reported irregularities in the termination installation cards.
This action on your request constitutes final agency action.
Accordingly, the
- report, as furnished to you, will be placed in the NRC Public Document Room seven days from the date of this letter.
