Request for Additional 'Information - Palo Verde Generating Station On Harch 15, 1982, the staff filed testimony with the Licensing Board for Palo Verde relating to the following contention (No. 5) in this proceeding:

"Applicant >~ill not have an assured supply of usable treated municipal effluent for cooling purposes for Unit 3 of PVNGS during months of pea(: reactor. need for the first five years of operations."

In the testimony, the staff concluded that there will be sufficieht usable treated municipal effluent from the 91th Avenue Plant, for operation of Units 1, 2 and 3 of PYNGS during months of peak reactor need for the first five years of operation.

This conclusion was based on the staff' under-standing of the terms of the current agreement (No. 13904) between the Palo Verde applicants and the city of Phoenix regarding the water to be provided to the Palo Verde plant.

Subsequently, by Hemorandum and Order, dated March 17, 1982, the Board noted that it,has been advised by ter. Bill Stephens, Executive Director of the Arizona ttunicipal Mater Users Association, that Agreement No. 13904 is currently being renegotiated.

As a result, we request that you advise us of the extent to which the current renegotiations could impact the staff's assumptions or conclusions included in its testimony regarding contention No. 5.

Me request that you provide this information by April 5, 1982 so that we may determine whether the staff's testimony needs to be revised prior to the start of hearing.
