ORDER IMPOSING CIVIL MONETARY PENALTY This refers to your letter dated February 23, 1990 in response to the Notice of Violation and Proposed Imposition of Civil Penalty (Notice) sent to you by our letter dated January 24, 1990.

Our letter and Notice describe violations of the environmental qualification requirements of 10 CFR 50.49 for electrical equipment important to safety.

You identified these violations after the November 30, 1985 deadline by which all electrical equipment important to safety was to be appropriately environmentally qualified.

The violations involved Limitorque IIIotor operators inside the containment and in the steam

tunnel, and containment fan motors.

The NRC staff recognized that you identified the violations and took prompt corrective actions to replace the deficient components.

However, to emphasize the importance of environmental qualification and meeting regulatory deadlines and given the scope of the violations, a civil penalty of $50,000 was proposed.

In your response you acknowledge that certain documentation deficiencies existed; however, you disagree with the NRC staff's evaluation of the violations and claim that subsequent correspondenIce demonstrated that a majority of the equipment listed in the Notice was qualifiable.

Based on this, you claim that this problem should be categorized as no greater than a Category C and there-fore no civil penalty should be imposed.

In addition, you do not believe that any regulatory purpose has been served by the Notice and therefore urge the use of enforcement discretion and withdrawal of the proposed civil penalty.

After consideration of your response, we have concluded for the reasons given in the Appendix attached to the enclosed Order Imposing Civil Monetary Penalty that:

(I) the Limitorque motor operators and containment fan motors, as they were found, have not beer demonstrated to=be qualified even considering the testing and information that was developed significantly after the end of the 1986 inspection, (2) the proper Eg category for the problem is a Category B,

and (3) the exercise of enforceIIIent discretion is not warranted in this case.
