Dear Mr. Maier:

By letter dated April 23, 1981 you submitted information regarding your sleeving of steam generator tubes at the R.

E. Ginna Nuclear Power Plant.

As par t of that submittal you included technical information held to be proprietary by the Babcock and Wilcox (B&M) Company, as attested to in the April 22, 1981 affidavit of James H. Taylor of B&W.

This affidavit re-quested withholding of the B&W information from public disclosure pursuant to 10 CFR 2.790.

The proprietary information submitted comprised data subsequently presented during an April 28, 1981 meeting with the NRC to discuss additional steam generator sleeving at the R. E. Ginna Nuclear Power Plant.

The reasons cited for the withholding of the B&M information included the fact that the infor-mation has consistently been held in confidence by B&W and that the information discloses processes or programs developed by B&W, the release of which could decrease the developmental costs of competitors and thus obviate the competi-tive advantage now enjoyed by B&M.

Me have reviewed the application and data based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned information sought to be withheld contains proprietary commercial information.

We also have found at this time that the right of the public to be fully'pprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of B&W's competitive position.

Accordingly, we have determined that the applicable information should be withheld from public disclosure.

Me, therefore, approve the request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding from public inspection as proprietary the report attached to your April 23, 1981 submittal.

This report is entitled "Steam Generator Sleeve Development

Program, R. E.

Ginna Nuclear Power Plant."
