APPENDIX A NOTICE OF VIOLATION Rochester Gas and Electric Corporation R.

E. Ginna Nuclear Power Plant Docket No. 50-244 License No.

DRP-18 During the inspection conducted on October 17 through November 20,

1988, and in accordance with the General Statement of Policy and Procedure for NRC Enforcement Actions 10 CFR Part 2, Appendix C (Enforcement Policy 1986),

the following viola-tion was identified:

10 CFR 50, Appendix B, section III requires, in part, measures shall be established to assure that appropriate quality standards are specified and included in design documents, and deviations from such standards are con-trolled.

The guality Assurance Manual Ginna Station, section 3, step 3.1.3 requires modifications involving a change to the facility as described in the Updated Final Safety Analysis Report (UFSAR) have a safety evaluation in ac-cordance with 10 CFR 50.59.

Contrary to the above, on October 5, 1988 a modification involving a change to the Condensate Storage Tank, described in Chapter 10 of the UFSAR as the main source of water for the Auxiliary Feedwater

system, was installed without a safety evaluation in accordance with 10 CFR 50.59.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Rochester Gas and Electric is hereby required to submit to this office within 30 days of the date of the letter trans-mitting this Notice, a written statement or explanation in reply, including:

(1) the reason for the violation if admitted, (2) the corrective steps which have been taken and the results

achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
