APPENDIX A NOTICE OF VIOLATION Rochester Gas and Electric Corporation Ginna Nuclear Nuclear Power Plant Docket NO. 50-244 As a res'ult of the inspection conducted on July 26-29, 1988, and in accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions",

10 CFR Part 2, Appendix C (Enforcement Policy) (1986),

the following violation was identified.

A.

Title 10, Code of Federal Regulations, Part 50.54(t) requires licensees'who are authorized to operate a nuclear power facility to provide for a review of it's emergency preparedness program at least every 12 months.

This review shall include an evaluation for adequacy of the interface with State and local governments.

In addition, the results of this determination shall be made available to the State and local governments.

Contrary to the above, Rochester Gas and Electric Corporation failed to evaluate the adequacy of the interface with the State of New York and Honrae and Wayne Counties for four of the previous seven years and failed to make available the results of the evaluation available to the state/local governments for six of the seven years.

Pursuant to the provi sions of 10 CFR'2.201, Rochester Gas and Electric Corporation is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the reason for the violation; if admitted; (2) the cor'rective steps which have been taken and the results achieved; (3) corrective steps which will be taken to avoid further violations; and (4) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
