AND NOTICE OF VIOLATION.
Dear Hr. Plunkett:
On May 9,
1998, the
NRC completed
an inspection at your St. Lucie
1 and
2
reactor facilities.
The enclosed
report presents
the results of that
inspection.
Based
on our inspection findings and your completed
and planned actions.
the
NRC staff is closing our review of the Generic Letter 89-10 program.
"Safety-
Related Hotor-Operator Valve Testing
and Surveillance," at St. Lucie.
In addition.
based
on the results of this inspection,
the
NRC has determined
that violations of. NRC requirements
occurred.
The violation regarding
equipment clearance
orders is of concern
because if not implemented properly.
a clearance
challenges
not only the safety of the plant, but the safety of the
personnel
as well.
Additionally, this violation is repetitive and its
recurrence
indicates
inadequate corrective action was taken with a previous
violation.
Repetitive violations are addressed
in the NRC's "Statement of
Policy and Procedure for NRC Enforcement Actions." (Enforcement Policy),
NUREG-1600, Section
IV.B'.
The Enforcement Policy allows the severity level of
a violation to be increased if the violation can be considered repetitive.
For example.
a Severity Level
IV violation could be increased to Severity
Level III with the attending escalated
enforcement action.
However, in this
case.
we have. decided not to increase
the severity level of this violation
based
on the depth
and timeliness of your corrective actions to this violation
and your overall satisfactory
performance in this area.
These violations are cited in the enclosed
Notice of Violation, and the
circumstances
surrounding the violations are described in detai 1 in the
enclosed
report.
Please
note that you are required to respond to this letter
and should follow the instructions specified in the enclosed
Notice when
preparing your response.
The
NRC will use your response,
in part, to
determine whether further enforcement
action is necessary to ensure
compliance
with regulatory requirements.
