ST. LUCIE PLANT, UNIT NOS.

1 AND 2, SCHEDULE FOR IMPLEMENTATION OF THE ATWS RULE (TAC NOS. 59144 AND 59145)

This letter is in response to your letter dated May 19, 1987, concerning the above subject.

You stated that the Florida Power and Light Company (FPSL) planned to submit the St. Lucie plant-specific ATWS evaluation information by July 15, 1987.

In addition, you requested that the St. Lucie Plant, Unit 2

'ATWS rule implementation schedule be delayed until the fourth outage after July 24, 1984, currently scheduled for March 1989.

Current staff guidance, as sent to you by NRC letter dated March 16, 1987, calls for implementation of the ATWS Rule by no later than the third refueling outage after July 24, 1984.

A request for a delay beyond the third outage is handled on a case-by-case basis ifit is presented in a timely fashion, and can be adequately justified.

The third refueling outage after July 24, 1984, for the St. Lucie Plant, Unit 2 is scheduled for October 1987.

Based upon (1) an FP8L submittal schedule of July 15, 1987, (2) the need for NRC review and approval of FP8L's proposed implementation, and (3) the need for detailed FP8L engineering and procurement activities following NRC

approval, the staff agrees that the ATMS ruie implementation scheduie tgr Un 2 would need to be delayed until the fourth outage after July 24, 198

Mr. C. 0. Woody In regard to St. Lucie Plant, Unit I, we acknowledge that you are not requesting a delay.

However, should unexpected delays occur, a request for an implementation delay may be necessary.

If unexpected delays do occur, we will entertain a request for a delay beyond the third outage for Unit 1 if it is presented in a timely fashion, and can be adequately justified.
