Dear Mr. DelGeorge:
The enclos~d report refers to.an onsite inspection by an NRC Special
Inspection Team on November 30 through December 4, 1992, at the Dresden
- Nuclear Power Plant relative to a control rod mispositioning event that
occurred on September 18, 1992, and the failure to report that event in
accordance with station procedures.
The team was composed of Messrs. P. L.
Hiland, F. L. Brush_, and H. Peterson, of this office; and Mr. B. L. Siegel of
the Office of Nuclear Reactor Regulation (NRR).
The enclosed copy of our report identifies areas examined during the
inspection.
Within these ar~as, the inspection consisted nf a selective
examination of procedures and representative records, observations, and
interviews with personnel.
The purpose of the inspection was to conduct a thorough and systematic review
of the September 18 event in order to determine the causes, conditions, and
circumstances pertaining to it, and to communi~ate to NRC.management the facts
and safety concerns related. to the event.. In combination with this
inspection, a review of previous similar events was also conducted.
Based on the results of this inspection, two apparent violation~ were
identified and are being considered for escalated enforcement action in
accordance with the "General Statement of Policy and Procedure for NRC
Enforcement Actions" (Enforcement Policy), 10 CFR Part 2, Appendix C.
The
apparent violations concern the failure to implement adequate .corrective
action for an April 10, 1992, control rod misposition event and failure to
follow plant procedures (multiple examples) during the September 18, 1992,
control rod misposition event. Accordingly, no Notice of Violation is
presently being issued for these inspection findings.
In addition, please be
advised that the number and characterization of apparent violations described
in the enclosed inspection report may change as a result of further NRC
review.

We are particularly concerned because the September 16, 1993, control rod
mispositioning event may have .been prevented by adequate corrective actions
for a previous event. Further, the apparent root cause of the procedural
violations was deliberate misconduct.
An enforcement conference to discuss these apparent violations has been
scheduled for September 16, 1993.
The purposes of this conference are to
discuss the apparent violations, their root causes and their safety
significance; to provide you the opportunity to point out any errors in our
inspection report; and to provide an opportunity for you to present your
proposed corrective actions.
In addition, this is an opportunity for you to
provide any information concerning your perspective on the severity of the
issue, the factors that the NRC considers when it determines the amount of a
civil penalty that may be assessed in accordance with Section VI.B.2 of the
Enforcement Policy, and the possible basis for exercising discretion in
accordance with Section VII of the Enforcement Policy.
You will be advised by
separate correspondence of the results of our deliberations in this matter.
No response regarding these apparent violations is required at this time.
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of
this letter and the enclosed inspection report will be placed in the NRC
Public Document Room.
We will gladly discuss any questions you may have concerning this inspection.
