SUBJECT:

NRC INTEGRATED INSPECTION REPORT 50-387/98-03, 50-388/98-03;

NOTICE OF VIOLATION;AND EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Byram:

On June 8, 1998, the NRC completed an integrated inspection at your Susquehanna

Steam

Electric Station (SSES)

1 5 2 reactor facilities. The inspection covered routine activities by

the resident inspectors and announced

inspections by inspectors from the NRC Region

I

office. The enclosed report presents the results of these inspections.

The inspectors

discussed the findings of this inspection with Mr. G. Kuczynski, General Manager SSES,

and others of your staff at the exit meeting on June 9, 1998.

During the 6-week period covered by this inspection report, your conduct of activities was

characterized

by safe operation and refueling activities on Units 2 and

1 respectively.

Decision making was generally conservative.

Based on the results of this inspection, the NRC has identified violations of NRC

requirements.

These violations are cited in the enclosed Notice of Violation (Notice) and

the circumstances

surrounding them are described in detail in the subject inspection report.

The violations are of concern since they indicate weaknesses

in the control of safety

related maintenance activities.

Weaknesses

in the control of maintenance

activities,

in'eneral,

have resulted in several past transients at Susquehanna.

The NRC also reviewed a licensee identified issue involving the operability'of 4.16 KV

switchgear busses

due to 4.16 KV breakers that were not being maintained in their

dynamically qualified position.

The issue is a violation of NRC requirements, which could

be considered for escalated'enforcement

and be subject to a civil penalty.

However, after

consultation with the Director, Office of Enforcement and the Regional Administrator,

I

have been authorized to exercise discretion to not issue a Notice of Violation and not

propose

a civil penalty in accordance with the provisions provided in Section VII.B.3 of the

NRC's Enforcement Policy. This decision was made after consideration that: (1) the

violation was identified by your staff's good questioning attitude during voluntary

initiatives; (2) corrective actions were comprehensive

and timely; (3) the conditions were

subtle in nature and not likely to be disclosed through routine surveillance or quality

assurance

activities; and (4) the violation is not reasonably linked to current performance.

The exercise of discretion acknowledges your good effort to identify and correct subtle

violations, that would not be identified by routine efforts, before the degraded safety

systems

are called upon.

In NRC Inspection Report 50-387,388/97-03,the

NRC dispositioned

LER 50-387/97-008

concerning your identification that Technical Specification Response

Time Testing

requirements were not being met.

In reviewing this matter, the NRC concluded that your

LER was insufficient in that it did not address the inadequate

10 CFR 50.59 safety

evaluation as a cause of not meeting the TS requirements

and therefore did not specify any

corrective actions proposed or taken for the inadequate safety evaluation.

While we are

not reopening any enforcement action pursuant to Section XIIIof the NRC's Enforcement

Policy, it is requested that you either supplement the LER or otherwise address

on the

docket your corrective actions taken or proposed for the failure of your 10 CFR 50.59

safety evaluation process.

You are required to respond to this letter and should followthe instructions specified in the

enclosed Notice when preparing your response.

The NRC will use your response,

in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"

a copy of this letter,

its enclosure(s),

and your response will be placed in the NRC Public Document Room

(PDR).
