This letter refers to the Enforcement

Conference

held

on November 21,

1989, at

the Region I Headquarters.

The conference

was conducted

by Mr. Robert Gallo

with members of your staffs

The purpose

of. the conference

was to discuss

the

apparent violation identified by the

NRC during the Training Program

Team

Inspection

conducted August 21-25,

1989.

The report documenting this inspec-

tion was sent to you by letter dated October 26,

1989.

The apparent violation

concerned

the provision in"the requalification program implementing procedure

that allowed the assignment

of licensed duties to personnel

that had failed

a

required comprehensive written examination or annual

operating test prior to

successful

retraining

and retesting.

As

a result of this inspection

and

subsequent

enforcement

ccnference,

a failure to comply with NRC regulatory

requirements

was identified.

To emphasize

the

need for adequate

controls to assure

that properly qualified

licensed

persons

are assigned

licensed duties, this office is issuing

a Notice

of Violation enclosed

as Appendix

A to this lette~.

The violation described

in

Appendix A involved

a failure to provide adequate

controls to assure

that pro-

ficient operators

licensed

pursuant to 10 CFR 55 were assigned

licensed duties.

This occurred

when

a senior reactor operator

(SRO),

who had failed an annual

operating test

and, thus, did not satisfy the requirements

per

10 CFR 55.59

(a)(2),

was assigned

licensed duties in January

and February

1989.

The

NRC

recognizes

that other properly qualified licensed operators

were present

in the

control

room while this

SRO was

on shift.

We note that your short term correc-

tive action to change, the implementing procedure

was appropriate.

As described

at the enforcement

conference,

your initiative to revise regulatory

based

documentation

to meet Regulatory Guide 1.8, Revision 2, is

a comprehensive,

long-term corrective action.
