APPENDIX A Notice of Violation Niagara Mohawk Power Corporation Nine MilePoint Unit 2 Docket No. 50-410 License No. NPF-69 During an NRC inspection conducted on May 24 - July 4,

1992, a violation of NRC requirements was identified. In accordance with the "General Statement ofPolicy and Procedure for NRC Enforcement Actions," 10 CFR 50, Part 2, Appendix C (1991), the violation is listed below.

Nine Mile Point Unit 2 Technical Specification 3.8.1.b and Technical Specification Definition 1.27 require, in part, that in modes 1, 2, and 3, EDG*2 (HPCS-Division III) shall be capable of performing its specified function of transferring and supplying its safety loads following a loss of off-site power during surveillance testing.

This design function is specified in USAR section 8.3.

Contrary to the above, since initial construction, in modes 1, 2, and 3, EDG 2 was not capable ofperforming its specified function of transferring and supplying its safety loads following a, loss of off-site power during surveillance testing.

This constituted a Severity Level IV Violation (Supplement 1).

As discussed in Combined Inspection Report 92-15 and 92-17, the limiting condition for operation in this situation was not violated and NMPC took adequate corrective actions to address this violation and to prevent recurrence.

Therefore, no response to this violation is iequlred.
