PROPOSED IMPOSITION OF CIVIL PENALTIES S200,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of
$200,000 will be issued on or about May 21, 1992 to Niagara Mohawk Power Corporation.
This action is based on two Severity Level III violations.
The first violation involved multiple failures of plant personnel to follow established work control processes and procedures which resulted in the isolation of the Service Water and Emergency Service Water Systems from Lake Ontario, the plant's ultimate heat sink.
The civil penalty was escalated by 100% for poor past performance in procedure compliance and mitigated by 50% for the licensee's corrective actions.
The second violation involved the licensee's failure to recognize that certain technical specifications (TS) scram functions were being automatically bypassed, putting the plant outside the TS Limiting Condition for Operation.
The scram functions were the turbine stop valve closure reactor trip and the generator load rejection reactor trip.
The civil penalty was escalated 50% for NRC identification and 100~ for the duration of the violation in light of the opportunities to identify the violations earlier.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice May 21, 1992 Telephone Notification of Licensee May 21, 1992 The State of New York will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
