NRC Region I'Combined Inspection Report Nos. 50-220/92-02 and 50-410/92-02

This refers to the results of the routine resident safety inspection conducted by Mr. W. Schmidt

and others from January 26 through February 29,

1992 at Nine Mile Point Units

1 and 2,

Scriba, New York. Mr. Schmidt discussed

the inspection finding with members of your staff

at the exit meeting conducted on March 13, 1992.

This inspection was directed toward areas important to public health and safety.

The enclosed

NRC Region I Inspection Report describes

the areas examined during the inspection.

Within

these areas,

the inspection consisted of observation of activities in progress,

interviews with

personnel,

and selective examinations of procedures

and representative

records.

Your staff operated Units

1 and 2 safely over the inspection period.

Performance at Unit 2 was

generally good.

However, poor performance of the Unit 1 staff led to the isolation of the unit

from its ultimate heat sink (Lake Ontario) on February 21, 1992. An augmented in'spection team

(AIT) was sent to the site to review this issue.

The enclosed report documents our continued review of the Unit 1 inadvertent partial bypass of

the turbine generator trip anticipatory reactor scram that occurred twice during January

1992.

The NRC is concerned that the appropriate actions, as required by your technical specifications,

were not taken in either event. It is not evident to us, based on a review of the associated

logs

and documentation, that you fullyunderstood and adequately assessed

the consequences

to plant

safety during these instances.

This is considered an apparent violation. We understand that you

have since undertaken a number ofcorrective actions to minimize the potential recurrence of this

situation.

Based on the results ofthis inspection, the apparent violation discussed above is being considered

for escalated

enforcement action, in accordance

with the "General Statement of Policy and

Procedure for NRC Enforcement Actions" (Enforcement Policy), 10 CFR Part 2, Appendix C

(1991). Accordingly.no Notice ofViolation is presently being issued for this inspection finding.

Please be advised that the number and characterization of apparent violations described in the

enclosed inspection report may change as a result of further NRC review.

An enforcement

conference

to

discuss

this

apparent

violation

has

been

scheduled

for-

April 8, 1992.

The purposes of this conference are to discuss the apparent violation, its causes

and safety significance; to provide you the opportunity to point out any errors in our inspection

report; to provide opportunity for you to present your proposed corrective actions; and to discuss

any other information that will help

us determine

the appropriate

enforcement

action in

accordance with the Enforcement Policy. In particular, we expect you to be able to discuss why

the operators did not comply with the technical specifications, why the deficiency event report

system was not used, your overall corrective actions and why previous actions were not fully

effective in minimizing events resulting from inattention-to-detail.

You will be advised by

separate

correspondence

of the results of our deliberations

on this matter.

No response

regarding this apparent violation is required at this time.
