By letter dated September 19, 1991, Niagara Mohawk Power Corporation (NMPC) requested a one-time exemption from the requirement of 10 CFR Part 50, Appendix E, Section IV.F.2, to conduct the annual exercise of the Nine Mile Point emergency plan in 1991.
Additional information was provided by NMPC's letter dated November 14, 1991, which was submitted in response to the NRC staff's request for additional information dated October 23, 1991.
The NRC staff has reviewed the information provided in support of NMPC's request for exemption.
On the basis of the submitted information and as discussed in the enclosed Exemption, the NRC staff has concluded that the requested one-time exemption is justified for 1991.
Thus your request for exemption is granted.
Me find that granting the exemption undue risk to the public health and defense and security, and meets the 50.12(a) (2)(ii).
