CONFORMANCE TO REGULATORY GUIDE 1.97, REVISION 2 - NINE MILE POINT NUCLEAR POWER STATION UNIT NO. I (TAC NO. 69209)

N NRC Generic Letter 82-33 requested licensees to provide a report to the NRC describing how the post-accident monitoring instrumentation in their facilities meets the recommendations of Regulatory Guide (R.G.) 1.97, Revision 2, as app'Iied to emergency response facilities.

By letter dated April 2, 1984, Niagara Mohawk Power Corporation (NMPC) submitted its response for Nine Mile Point I; additional information was provided by letters dated October 18,

1985, and December 6, 1985.

The NRC staff's evaluation of NMPC's submittals was provided in the staff's safety evaluation dated November 17, 1986.

In response to the staff's safety evaluation and NRC Inspection Report 50-220/88-34, dated January 23,

1989, NMPC submitted an action plan for resolution of R.G. 1.97 post-accident monitoring equipment issues at Nine Mile Point 1.

By letter dated July 31,

1989, NMPC submitted information which superseded its previous information; additional information was also provided by letters dated May 25, 1990, October 29, 1990, and August 26, 1991.

The NRC staff and its consultant, EG8G Idaho, Inc., have completed reviewing NMPC's responses to Gener ic Letter 82-33.

Our evaluation is contained in the enclosed supplemental safety evaluation which is based on our review of EG&G's Technical Evaluation Report EGG-NTA-9161, dated September 1991.

We find the instrumentation provided. by NMPC for Nine Mile Point 1 acceptable for meeting the recommendations of R.G. 1.97, Revision 2, except for the variable neutron flux.

Neutron, flux instrumentation is the subject of a Boiling Water Reactor Owners Group (BWROG) appeal of the NRC staff position that directed licensees gaol I

Upon resolution of the appeal, NHPC shou'ld" comply with the resolution of that appeal.

In the interim, we find the existing neutron flux instrumentation acceptable.

This completes our activity on TAC No. 69209.
