SUBJECT'INE MILE POINT NUCLEAR STATION UNIT 2 RELIEF REQUEST FROM INSERVICE TEST REQUIREMENTS FOR SNUBBERS (TAC NO. 77198)
By letter dated July 17, 1990, Niagara Mohawk Power Corporation, the licensee, submitted Relief Request No.
RR-IWF-4 from inservice test requirements for snubbers for Nine Mile Point Nuclear Station Unit 2.
The staff has reviewed the relief request and provided the enclosed Safety Evaluation.
The staff has concluded that the burden placed on the licensee by the requirements of both the Technical Specifications (TS) and the 1983 ASME Boiler and Pressure Vessel Code Section XI (Section XI) for snubber inservice surveillance is unwarranted.
Therefore, pursuant to 10 CFR 50.55a(a)(3)(i)
Relief Request No. RR-IWF-4, which deletes the requirements of Section XI from the NMP-2 inservice testing Program Plan, is granted to the licensee for snubber surveillances.
Such testing requirements will henceforth be contained only in the TS.
For the relief that is being granted the staff has determined that the code requirements are impractical and that the relief requests are authorized by law and will not endanger life, property or the common defense and security and are otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the facility.
The request for relief complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission has made appropriate findings as required by the Act and the Commission's results and regulations in 10 CFR Chapter 1.
Accordingly, relief from certain provisions of Section XI of the ASME Boiler and Pressure Vessel Code and the applicable addenda is hereby granted, as described in the enclosed Safety Evaluation.
