NINE MILE POINT UNIT 2 RELIEF RE(UESTS FOR PRESERVICE INSPECTION PROGRAM (TAC NO. 66070)

The NRC staff's Materials and Chemical Engineering Branch, with its consultant, Idaho National Engineering Laboratory, has reviewed and evaluated information submitted in a letter dated July 29, 1987, by the Niagara Mohawk Power Corporation revising the Preservice Inspection Program Plan for the Nine Mile Point Nuclear Station, Unit 2.

The staff concludes from its evaluation that the Preservice Inspection Program Plan is acceptable and in compliance with 10 CFR 50.55a(g)(2).

Relief from impractical Section XI ASME Code requirements is granted as requested for Relief Requests RR-IWF-1, RR-IWF-2, RR-IWF-3, and RR-IWF-4.

For the relief that is being granted, we have determined that the code requirements are impractical and that the relief requests are authorized by law and will not endanger life, property or the common defense and security and are otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the faci 1 ity.

The requests for relief comply with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission has made'ppropriate findings as required by the Act and the Commission's results and regulations in 10 CFR Chapter 1.

Accordingly, relief from certain provisions of Section XI of the ASME Boiler and Pressure Vessel Code and the applicable addenda is hereby granted, as described in the enclosed Safety Evaluation.
