NINE MILE POINT UNIT 1 - REVISED AND ADDITIONAL RELIEF REQUESTS FOR THE FIRST TEN-YEAR INTERVAL INSERVICE INSPECTION PROGRAM (TAC NOS. 74187,
- 74582, and 75317)
We are responding to your letters dated August 16, September 8,
and November 9, 1989, wherein the N;;.agar a Mohawk Power Corporation transmitted to the NRC additional and revise~ elief requests for the First Ten-year Interval Inspection Program for Nine l e Point Unit 1.
These requests are additional to or revise some of the rea'sts addressed in previous submittals.
We have reviewed the requests and determined that the licensee has provided justification to warrant the granting of the relief requests with the exception of Relief Requests 1IIRR18 and 1IIRR22.
These two relief requests have been denied with the stipulation that the Section XI requirements be performed during the next refueling outage.
The staff's evaluations of the relief requests in the three submittals dated August 16, September 8 and November 9, 1989, are provided in Enclosures 1 and 2 and the attached Table.
The Table has been updated from the staff's previous evaluation of First Ten Year Interval relief requests that was issued on August 11, 1989.
The Table now includes those relief requests as revised and augmented by the later relief requests in the three letters noted above.
For the relief that is being granted, we have determined that the Code requirements are impractical and that the relief requests are authorized by law and will not endanger life, property or the common defense and security and are otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the fac i 1 ity.
The requests for relief comply with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission has made appropriate findings as required by the Act and the Commission's rules and regulations in 10 CFR Chapter l.
Accordingly, relief from certain provisions of Section XI of the ASME Boiler and Pressure Vessel Code and the applicable addenda is hereby granted, as described in the enclosed Safety Evaluation.
