APPENDIX A Notice of Violation Niagara Mohawk Power Corporation Nine Mile Point Unit 1

DRP-63 During an inspection of Raychem Splices conducted June 12-16,

1989, and during the routine safety inspection conducted between December 14, 1989 and January 31,
1990, and in accordance with the "General Statement of Policy for NRC Enforcement Actions,"

10 CFR Part 2,

Appendix C,

(Enforcement Policy)

(1989), the following violations were identified.

A.

10 CFR 50.49 paragraph (f) and (g) require that each item of electrical equipment important to safety be qualified and that qualification must be completed at a time no later than November 30, 1985.

Contrary to the

above, on June 16,
1989, the qualification of the three-wire, V-type splice configuration used at Unit 1 was not established, in that:
1) test data could not be provided at the time of the inspection to establish qualification of the three
wire, V-type splice configuration, and
2) there was no similarity analysis between the two wire, V-type splice test specimens and the installed three
wire, V-type splice configuration.

This is a Severity Level IV Violation (Supplement 1).

B.

Technical Specification 6.8. 1 states that written procedures and adminis-trative policies shall be implemented to meet or'xceed the requirements of Appendix A of Regulatory Guide 1.33.

Regulatory Guide 1.33, Appendix A, states that administrative procedures shall be implemented for equip-ment control (e.g.,

locking and tagging).

Nine Mile Point Nuclear Station Administrative Procedure AP-4.0, Adminis-tration of Operations, Revision 13, states that a change to a system con-figuration not within the scope of an approved operating, surveillance, or special test procedure shall be controlled in accordance with Equipment Markup Procedure AP-4.2.

Specifically, off normal positioned control switches shall be tagged with yellow hold out tags.

Contrary to the

above, on January 15,
1990, the source range monitor ¹14 toggle switch was placed in bypass due to a

component failure and not properly tagged.

In

addition, on January 24,
1990, the inspectors identified nine pump switches on the unit control panels in pull-to-lock which were not properly tagged with yellow holdout tags to identify and control their off normal configuration.

This is a Severity Level IV Violation (Supplement 1).

Appendix A Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Company is hereby required to submit to this'ffice within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in

reply, including:

(1) the corrective steps which have been and/or will be taken to avoid further violations; and (2) the date when full compliance will be achieved.

Regarding violation a.,

the technical aspects regarding

the, qualification of the splice configuration have been reviewed and accepted by'he NRC; therefore, the response need not address this.

Where good cause is shown, consideration will be given to extending this response time.
