CLOSE-OUT OF OPEN ITEMS RESULTING FROM THE GAGE-BABCOCK AUDIT OF THE FIRE PROTECTION PROGRAM (TAC NO. 72442)

Amendment No.

33 to Facility Operating License No.

DPR-63 for the Nine Mile Point Nuclear Station, Unit 1 (NMP-l), was issued on July 26, 1979.

The amendment issued the Fire Protection Safety Evaluation Report (FPSER).

As part of the NMP-1 Restart Action Plan (RAP), Niagara Mohawk Power Corporation (the licensee) committed to evaluate and close out open items resulting from the Gage-Babcock audit of the Fire Protection Program.

By letter dated November 3, 1989, the licensee advised the staff that, as a

result of the audit, it was found that some installed modifications differed from the FPSER.

The licensee provided the staff with a case-by-case evaluation of the issues identified in Sections 3.1.8(1), 5.3.1.6, 4.3.1.6,

3. 1.9 and 5.4.3.6.

The licensee concluded that, although in three specific instances the installed modifications differ from the FPER, the differences do not result in a decrease in the effectiveness of the NMP-1 fire protection program.

The staff has reviewed the licensee's evaluation and agrees with the licensee's conclusion because in each case the identified difference satisfies the literal requirements of Appendix R to 10 CFR Part 50.
