SUBJECT:

REGULATORY GUIDE 1.97 - NINE MILE POINT UNIT NO.

1 By letter dated May 19,

1989, Niagara Mohawk Power Corporation responded to NRC's April 21, 1989 letter identifying eight issues with respect to Regulatory Guide 1.97 requiring resolution prior to Unit 1 restart.

Specifically, your letter provided Niagara Mohawk's action plan to address the issues identified.

The staff has reviewed your response and finds your action plan acceptable for five of the eight issues.

We will complete our review following receipt of documentation of your completed actions.

The three remaining issues (isolation, failure modes and effects analysis, and reactor vessel water level instrumentation) require. further information.

We discussed these three remaining issues and your proposed actions to address them'ith members of your staff during a June 6,

1989, telephone conference call.

With, respect to the isolation defi.ciencies, it is our understanding that Niagara Mohawk is conducting an assessment of the short-term adequacy of the present is'olation configuration and evaluating a

proposed long-term modification which would eliminate the isolation defi-ciencies between the plant process computer and the Emergency Operating Procedure (EOP) key parameter instrumentation.

It is also our understanding that you will inform the NRC in mid-July of the results of your actions.

Upon receipt of this information and the results of your failure modes and effects analysis, the staff will be able to determine the acceptability of your present and proposed isolation configuration.

With respect to the reactor vessel water level instrumentation, you indi-cated that your actions are consistent with resolution of Generic Issue (GI)

101, "BWR Water Level Redundancy."

The staff agrees that this is an accept-able approach to demonstrate that the consequences of a single failure of a common reference leg in the Fuel Zone Level indicating system can be mitigated.

However, to facilitate staff review, we request that you evaluate the issue with respect to the corresponding NUREG/CR-5112 "Evaluation of Boiling Water Reactor Water - Level Sensing Line Break and Single Failure" and prepare the results for inspection.

This is consistent with the review requested by Generic letter 89-11 of June 30, 1989.

The acceptability of your evaluation is dependent upon the results being consistent with the NUREG.

Several of your action plan items are noted to have a completion date of unit restart.

It is recommended that Niagara Mohawk complete these items as early as possible prior to restart to allow sufficient time for staff review.

Additionally,'we intend to conduct a follow-up Regulatory Guide 1.97 inspection prior to Unit 1 restart to support resolution of the remainin issues.
