Confirmatory Action Letter 88-17 This letter confirms commitments made by you on July 12, 1988 regarding action to be taken prior to restart of Nine Mile Point Unit 1 (NMPl).

We acknowledge your response to an earlier Confirmatory Action Letter (CAL 88-13) addressing the maintenance of operator.licenses.

We further acknowledge discussions during a meeting between you and members of your staff and the NRC staff on June 20, 1988 relative to a variety of other technical restart issues including Inservice Inspection Program deficiencies, feedwater system deficiencies, problems with control of commercial grade

items, and fire barrier

'enetration deficiencies.

The fire protection deficiencies were discussed during an enforcement conference on July 11, 1988 and are currently being evaluated by the NRC for appropriate enforcement action.

Based on these issues and the recent problems identified by the NRC team inspection with Unit 1 operator knowledge of emergency operating procedures (documented in inspection report 50-220/88-22),

as well as your prior enforce-ment history at Nine Mile Point Units 1 and 2 (seven civil penalties and fifteen enforcement conferences since 1983), you agreed not to restart Unit 1

until the following additional actions are completed:

l.

Determine and document your assessment of the root cause(s) of why Niagara Mohawk line management has not been effective in recognizing and remedying problems, in particular the problems which were the subject of CAL 88-13 (maintenance of operator licenses),

Inspection Report 50-220/88-22 (licensed operators'nowledge and use of emergency operating procedures),

and the issues discussed during the June 20, 1988 meeting at Region I.

2.

Prepare a proposed restart action plan, and submit it to the

NRC, Region I Regional Administrator, for review and approval.

The plan will identify all actions required to be completed prior to startup and a schedule for completion of all other actions to be completed after'startup that are needed to address the root cause(s) identified in Item 1.

For actions proposed for completion after restart, you will provide justification for why completion after restart will not have an adverse impact on safe plant operation.

Provide a written report relative to the readiness of NMP1 for restart.

Include in this report a) your bases for concluding that NMP1 is ready for restart, b) a self-assessment of the implementation of the restart action plan, and c) your conclusions regarding whether Niagara Mohawk's current line management has the appropriate leadership and management skills to prevent, or detect and correct, future problems.

Further, we understand that restart will not occur until you receive authori-zation from the Region I Regional Administrator.

The responses directed by this letter are not subject to the clearance procedures of the Office of-Management and Budget, as required by the Paperwork Reduction Act of 1980, PL 96-511.

Issuance of this Confirmatory Action Letter supersedes CAL 88-13 and does not preclude the issuance of an order formalizing the above commitments.
