USE OF ASME CODE CASE N-415 FOR THE INSERVICE TESTING (IST)
PROGRAM AT NINE MILE POINT UNIT 2 (TAC 67172)
By letter dated January 8, 1988, the Niagara Mohawk Power Corporation requested permission to use the ASME Boiler and Pressure Vessel Code Section XI Code Case N-415 in the Nine Mile Point Unit 2 (NMP-2) Inservice Testing Program.
Code Case N-415, "Alternative Rules for Testing Pressure Relief Devices," will be used for testing relief valves, safety values and rupture discs in the pump and valve testing program.
Code Case N-415 allows the use of the testing requirements of ANSI/ASME Standard OM-1-1981 as an alternative to the requirements of Subsection
- IWV,Section XI, Division 1 of the ASME Boiler and Pressure Vessel Code.
As indicated in the footnotes to 10 CFR 50.55a, the use of certain Code cases may be authorized pursuant to 50.55a(a)(3).'0 CFR 50.55a(a)(3)(i) permits licensees to propose alternatives to the regulatory requirements when the licensee can demonstrate that the proposed alternative would provide an acceptable level of quality and safety.
Code Case N-415, was incorporated in Revision 5 of Regulatory Guide (RG) 1.147.
Incorporation into this RG indicates that following the requirements of the Code Case would provide an acceptable level of quality and safety for the testing of safety related pressure relief devices.
The RG endorsement does not contain any reservation; therefore, the Code Case is acceptable for the intended use without any restrictions in operating plants.
On the basis of the above discussion and pursuant to 10 CFR 50.55a(a)(3)(i) the staff finds that the use of Code Case N-415 at Nine Mile Point, Unit 2
- 1) as endorsed by RG 1.147 provides an acceptable level of quality and safety, and 2) is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest.
Relief is hereby granted for the use of Code Case N-415 at Nine Mile Point Unit 2.
