GPA/PA JJohnson,RI By letter dated December 7, 1987 you requested relief from Section XI of the ASME Boiler and Pressure Vessel Code for the Nine Mile Point Nuclear Station, Unit No.

1 (TAC 67417).

Relief was requested from the requirement to perform the system leakage test of the Reactor Coolant Pressure Boundary at a test pressure not less than the nominal operating pressure associated with 100%

rated reactor power.

Your alternative was to perform the test at 900 psig in lieu of 1035 psig.

Your basis for the requested relief is that performing the test at the required conditions takes additional work which would delay startup.

Radiation considerations were not a basis for this request.

To qualify for relief from the requirements of 10 CFR 50.55a, you must demonstrate to the satisfaction of the Commission that the requirements are impractical.

He conclude that you have not provided a sufficient basis to show impracticality.

Therefore, your request for relief cannot be granted.
