This letter transmits
the results of the routine inspection
conducted
by
represen'tatives
of this office and
NRC headquarters
on December
11,
1987
through February 2,
1988 at Nine Mile Point Units
1 and 2, Scriba,
A
summary of the findings was presented
to Mr. T.
Roman,
Mr. R. Abbott and other
members of your staff at the conclusion of the inspection.
Your May 4,
1987 response
to Notice of Violation 50-410/87-02-01,
concerning
inadequate
reporting of a substantial
safety hazard,
has
been
reviewed
by my
staff.
The staff concludes that there is insufficient basis
(see
section
2.2.d of the attached
report) to retract the Notice of Violation based
upon
the justification provided in your response
and your recent history of NRC
identified reporting problems,.(reference
Inspection
Reports
50-220/86-12-01,
50-220/87-03
and 50-410/87-09).
However, your corrective actions
appear to
be adequate
and
no further enforcement
action is considered
necessary
at this
time.
Based
on the results of this inspection,
several
examples of level instru-
mentation setpoint calibrations
being in violation of the Unit 2 Technical
Specifications
were identified,
as set forth in the enclosed
Notice of
Violation, Appendix A.
This violation has
been categorized
as Sever ity
Level IV according to
10 CFR Part 2, Appendix
C (Enforcement Policy).
No
response
to this violation is required
because
the corrective actions
taken
by your staff were completed
and reviewed
and were determined
to be adequate
by the inspectors prior to the conclusion'f the inspection.
