APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Nine Mile Point, Unit 2

'ocket No. 50-410 License No.

NPF-69 As a result of the inspection conducted on August 31, 1987 to October 4,

1987, and in accordance with NRC Enforcement Policy (10 CFR Part 2, Appendix C) the following violation was identified:

Nine Mile Point Unit 2, Operating License NPF-69, Section 2.G, requires that a fire protection program be maintained in effect, as described in the Unit's Final Safety Analysis Report (FSAR).

10 CFR 50, Appendix R, Section III.L.7 requires that the isolation of associated circuits in safe shutdown systems shall be such that a

postulated fire will not prevent safe shutdown of the plant.

FSAR, Section 9B details the licensee's method for conforming to 10 CFR 50, Appendix R, Section III.L.

FSAR, Section 9B.5, Table 9B

~ 5-1, identifies thi.rteen valves which are required to be shut and electrically disabled, during'ormal operation, to protect against 'spurious operation due to fire induced hot shorts.

, Contrary to the above, on September 1,

1987, the thirteen high/low pressure interface valves required to be disabled per FSAR Table 9B.5-1 were energized, during normal operation at approximately forty percent of rated power.

This is a Severity Level IV Violation.

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending this response time.
