APPENDIX A NOl*ICE OF VIOLATION Niagara Mohawk Power Corporation

. Nine Mi 1 e Point, Unit 2 Docket No. 50-410 License No.

NPF-69 As a result of the inspection conducted on July 20, 1987 to August 30,

1987, and in accordance with NRC Enforcement Policy (10 CFR Part 2, Appendix C) the following violations were identified.

1.

Nine Mile Point Unit 2, Operating License NPF-69, section 2.G, requires that a Fire Protection Program be maintained in effect, as described in the unit's Final Safety Analysis Report (FSAR).

FSAR, section 9A.3.5.4.4, requires that administrative procedures be established to control flammable and combustible liquids, which are in full compliance with the National Fire Protection Association (NFPA)

Standard 30, Flammable and Combustible Liquid Code.

NFPA Standard 30, section 5-9 and Nine Mile Point Unit 2, Fire Department Procedure, N2-FDP-7, Control and Storage of Combustible and Flammable Materials, section 8.4, require that any leakage or spills of flammable or combustible liquids shall be contained and cleaned up promptly and that the cleanup material shall be stored in covered metal containers.

Contrary to the above, on several consecutive days before and on July 28, 1987 and August 26, 1987, oil soaked absorbant towels and oil puddles were observed at the base of the Division I and II Emergency Diesel Generator engine blocks.

This leakage was not promptly cleaned up and

'he absorbant mater.ials used were not properly disposed of.

This is a Severity Level V Violation (Supplement I).

2.

Nine Mile Point Unit 2, Technical Specification 3.4.9.2.b requires that with no Residual Heat Removal shutdown cooling mode loop in operation, within one hour restore shutdown cooling or establish reactor coolant circulation by an alternate method.

Contrary to the above, for a period of approximately two hours on August 13, 1987, neither loop of shutdown cooling was in operation and no alternate method of coolant circulation was established.

This is a Severity Level'V Violation (Supplement I).

Appendix A Pursuant to the provisions of 10 CFR 2.201, the Niagara Mohawk Power Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which have been taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending thi.s response time.
