CODE, SECTION XI, PARAGRAPH IWA-4120 (TAC 64230)

Re:

Nine Mile Point Nuclear Station, Unit No.

1 By letter dated January 22, 1987, as supplemented March 9, 1987, Niagara Mohawk Power Corporation requested relief from the Amer ican Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code,Section XI, Paragraph IWA-4120 requirement that repairs shall be performed in accordance with the design and construction code for a component.

This requirement is incorporated by reference in 10 CFR 50.55a.

The NRC can grant relief under 10 CFR 50.55a(g)(6).

Niagara Mohawk stated that Code repair of the Reactor Building Closed Loop Cooling (RBCLC) Heat Exchangers or component replacement is not practical at this time in light of the complexity of the weld repair and the lead time necessary to procure qualified replacement components.

The staff has reviewed the technical merits of the relief request and supporting information contained in the above letters.

The staff's safety evaluation concludes that the Code repair requirement is impractical to perform and has determined that the proposed alternatives to the described requirements will provide an acceptable level of quality and safety.

The staff also concludes that granting relief where the Code requirements are impractical is authorized by law and will not endanger life or property, or the common defense and security and is otherwise in the public interest considering the burden that could result upon Niagara Mohawk Power Corporation if the Code requirements were imposed upon Nine Mile Point, Unit l.

Accordingly, pursuant to 10 CFR 50.55a(g)(6)(i) of the Commission's regulations, Niagara Mohawk Power Corporation is granted the requested relief from the Code repair requirements for the RBCLC Heat Exchangers.

A copy of our Safety Evaluation is enclosed.
