RESPONSE

TO NMPC COMMENTS ON THE DRAFT LOW POWER LICENSE FOR NINE MILE POINT UNIT 2 NMPC comment:

For clarification page 3 item c(1) second line, should read "facility at steady state reactor core power levels not in excess of 3323..."

For clarification page 4, 1st paraaraph the line should read "pending commission approval, this license is restricted to steady state power levels not to...".

NRC response:

The proposed changes are unacceptable.

As the heading on this condition

states, this is the maximum power level.

These statements will remain as written in the draft.

NMPC comment:

Page 6 the first "(11)" chanqe to (10)

NRC response:

The number will be corrected NMPC comment:

Paqe 6 item (11) Operation with Reduced Feedwater Temperature (Section 15.1 SSER 4), first sentence after "facility" add "outside of the transient analvsis documented in Chapter 15".

Second sentence the words "After the first operating cycle," should be deleted.

NRC response:

This license condition will be revised to, read, "The facility shall not be operated with reduced feedwater temperature for the purpose of extending the normal fuel cycle.

The facility shall not be operated with a feedwater heating capacity less than that required to produce a feedwater temperature of 400'F at rated steady state con-'itions unless analyses supporting such operatioris are submitted by the licensee and approved by the staff."

Page' add item 13, which should discuss the Solid Radwaste system license condition discussed in SSER 3.

NRC response:

Because Nine Mile Point 2 will be using an approved alternate program for the Solid Radwaste

System, a license condition on this system may not be necessary.

This will be addressed in a future SER supplement.

NMPC comment:

Page 7 item D (iii) The first sentence should read "An exemption to Appendix A to 10 CFR Part 50 exempting the Control Rod Drive (CRD) hydraulic line (to the reactor recirculation pump purge) from General Design Criterion (GDC) 55."

Refer to a Letter from law offices Conner 5 Wetterhahn dated May 15, 1985.

NRC response:

This paragraph will be revised as discussed above.

NMPC comment:

Page 8 add (e} after the (V)(d) Item (e) should read "An exemption permit-ting completion of the preoperational tests for the reactor coolant, ECCS leak detection system are to be delayed until prior to initial criticality."

Refer to Niagara Mohawk letter dated May 7, 1986.

NRC response:

An exemption for the reactor coolant and ECCS leak dqtection system will be added to the license.

NMPC comment:

For information, pace 9 item H, please ensure that the license reads 40 years from issuance of the operating license.

(Refer to 1/25/83 applica-tion for operating license).

NRC response:

The staff is aware that the application is for a forty year license.

NMPC comment:

Page 4-1 of the Environmental Protection Plan, Section 4.1 third line, the words "within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> followed hy a written report" should be deleted.

This should be a thirty day report.

NRC response:

As stated in the draft license, an unusual or important environmental event will be required to be recorded and reported within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

Also as stated, a written report will be required in accordance with Section 5.4.2 of the Environmental Protection Plan (EPP).

Section 5.4.2 of the EPP requires a written report within 30 days of occurrence.

NMPC comment:

Page 5-2 of the Environmental Protection Plan, Section 5.4.1 first para-graph first sentence, it is unclear who gets the Annual Environmental Operatinq Report.

Please clarify the submittal requirements.

The second

'aragraph is vague about the requirement.

Is this asking for an evalua-tion of state reports or is it only asking for a copy of the report if there was monitoring required.

NRC response:

As stated in 5.4. 1 of the

EPP, an annual Environmental Operating Report as described in that section of the EPP will be required for Nine Mile Point Unit 2.

The report can be sent to the NRC Regional Administrator for Region I.

An example of an annual Environmental Operating Report is the annual report submitted by PECo for Limerick by letter dated April 28, 1986, from W. B. Willsey.

NMPC comment:

Page 5-3 of the Environmental Protection Plan, Section 5.4.2 nonroutine reports it savs that "a written report shall be submitted to the NRC".

'RC Regional Administrator at Region I.
