DPR-63 As a result of the inspection conducted on May 19, to July 6,
- 1986, and accordance with NRC Enforcement Policy 10CFR Part 2, Appendix C 1985, the following violation was identified:

- 3. 1. l.b.(3)(b) requires that whenever the reactor is below 20% rated thermal power and less than thirteen control rods have been withdrawn, no control rods shall be moved unless the Rod Worth Minimizer is operable.
Contrary to the above, on June 18, 1986, with the reactor in the startup mode, subcritical (less than 1% power),
and with fewer than thirteen control rods withdrawn, three control rods were withdrawn with the Rod Worth Minimizer inoperable.
Pursuant to the provsssons of 10 CFR 2.201, Niagara Mohawk Power Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:
( 1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending this response time.
