Application to Utilize an Alternative to 10 CFR 50.55a Concerning the Use of Authorized Nuclear Inspectors for Nine Mile Point, Unit 2 In a letter dated October 7, 1985, Niagara Mohawk Power Corporation (NMPC) sub-mitted an application to utilize an alternative to the requirements of 10 CFR 50.55a concerning the use of 'Authorized Nuclear Inspectors (ANIs) at Nine Mile Point, Unit 2.

The NMPC request involves the transfer of the Authorized Nuclear Inspector (ANI) functions for Classes I, 2, and 3 pipe supports, as required by Paragraphs NA-4520 and NA-5241 of Section III of the ASME Code, with an inspection program by the installer.

In addition, the NMPC request replaces the ANI Certification for Classes 1, 2, and 3 pipe supports with an Engineering Reconciliation Support Summary package and ASME documentation review and verification by the installer to assure that ASME Section III requirements have been met.

The staff has reviewed the NMPC proposal and does not agree with this deviation from the requirements of the Code.

It is the staff position that the ANI provides an independent review that verifies component quality in safety-related systems that is not provided by the proposed alternative.

Further, the staff finds that NMPC has not demonstrated that

( I) the proposed alternatives would provide an accept-able level of quality and safety, or (2) compliance with the specified require-ments of this section would result in hardship or unusual difficulty,without a compensating increase in the level of quality and safety for the reason stated above.

Therefore, NMPC should comply with the requirements of Section III of the Code in its entirety and the request to utilize an alter nate to 10 CFR 50.55a is denied.
