Nine Mile Point Nuclear Station, Unit No.
1 We have reviewed your letter of October 6, 1983, regarding your intent to meet the senior reactor operator staffing requirements of Section 50.54(m)(2) of 10 CFR Part 50 of the Commission's regulations, in part, by use of Shift Technical Advisors who are degreed engineers and who also have senior reactor operator licenses.
Use of individuals in this capacity is provided for in the draft Policy Statement published in the Federal Re ister on July 25, 1983.
We also note your request for a two-year extension of the effective date for the new staffing rule to be applied to Nine bile Point Unit 1 in the event the draft Policy Statement proves unacceptable to the Commission, to provide time to license additional SROs.
You did not mention it, but it is also possible that the dually-qualified individuals could be considered as SROs rather than STAs in the event the Commission disapproves the Policy Statement.
In that case, it appears you would need to hire and train new STAs and a request for exemption to the STA staffing requirements while this was being accomplished might be appropriate.
On the basis of the likely approval of the Policy Statement, we find your present commitment acceptable to meet the requirements of the new staffing rule effective January 1, 1984.
No extension is necessary since the regulation can be met by dually-qualified STA/SROs.
A copy of the Safety Evaluation supporting our finding is enclosed.
In the event the Commission ultimately disapproves the Policy Statement, we will consider an exemption, as may be necessary, for you to hire and train new STAs.
