Clarification of Specified Completion Date for Mark I Modifications Contained in NRC Order Dated January 19, 1982 Re:

Nine Mile Point Nuclear Station, Unit No.

1 On January 19, 1982 the NRC Issued an Order extending the completion date for the Mark I Long-Term Program at the Nine Mile Point Unit No.

1 facility to read:

"Prior to the start of Cycle 8 at the completion of'your Spring 1983 refueling outage."

The major modifications, which are those associated with the torus, vent system, internal structures and safety relief valve piping, comprise about 75Ã of the total program effort and have already been completed.

The remaining items are primarily associated with the torus attached piping modifications.

Since the date of issuance of the Order, leakage and cracking was identified in the, primary system piping which resulted in a maintenance outage to replace the affected piping.

From discussions with members of your staff and your letter of January 5, 1983, we understand that since the plant has not been operating, Cycle 7 will be completed in 1984 if plant operation is

resumed, as scheduled, in June 1983.

In response to your letter of January 5,

1983 we are providing you with our position regarding the interpretation of the completion date specified in the above referenced Order for completion of the Long-Term Mark I Program modifications.

The intent of the Order was to coordinate the implementation of the remaining modifications'ith a plant refueling outage (the reference to the Spring 1983 refueling outage was meant to be expository and is not considered binding) provided this was within the time frame considered acceptable by the Commission for completion of Mark I Program for a11 operating BWRs.
