0 APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Docket No. 50-220 I
Based on the results of an NRC inspection conducted on June 21, 22 and September 25-28, 1979, it appears that certain of your activities was not conducted in full compliance with NRC regulations and the conditions of your license, DPR-63, as indicated below.
Items A, B, and C are Infractions.
A.
"Exposure of individuals to radiation in restricted areas,"
requires that the whole body dose incurred by individuals in re-stricted areas be limited to 3 rem within any calendar quarter.
'ontrary to the above requirement, an individual working in the restricted area received a whole body dose of 3.79 rem during the second calendar quarter of 1979.
We note that this was rep'orted to this Regional Office in your letter dated June 15; 1979.
10 CFR 19.12, "Instructions to Workers," requires, in part, that all indivi-duals working in any portion of a restricted area be instructed:
in the health.protection problems associated with exposure to radioactive materials or radiation; in the-precautions or procedures to minimize exposure; and to
- observe, to the extent within the worker's control, the applicable provi-sions of Commission regulations and licenses for the protection of person-nel from exposures to radiation or radioactive materials.
Contrary to the above requirement, an individual worked in the drywell, a portion of the restricted area, during the second calendar quarter of 1979, and was not instructed in the health protection problems associ'ated with exposure to radioactive materials or radiation; nor was the individual instructed in the precautions or procedures to minimize exposure or to
- observe, to the extent within his control, the applicable provisions of Commission regulations and licenses for the protection of personnel from exposure to radiation or radioactive materials.
C.
Technical Specification
- 6. 11, "Radiation Protection Program," requires that procedures for personnel radiation protection be prepared consistent with the requirements of 10 CFR Part 20, and that they be approved, maintained, and adhered to for all operations involving personnel radiation exposure.

Procedure RP-1, "Access and Radiological Controls," states, in Section 4.3.3 that, "...Radiation areas should be entered only when necessary
- to perform a specific job.
When entered, time spent in the area should be kept to a minimum...."
Contrary to this requirement, on September 27, 1979, an individual was found resting in the prone position on what appeared to be a makeshi.ft bed located on the 261'levation of the Reactor Building, a posted radiation area.
The exposure rate measured in this location was 0.5 to 1 mrem/hr.
The individual was not engaged in the performance of a specific job.

Procedure RP-2, "Radiation Work Permit Procedure,"
states in Section 4.41) that, "The leadman must be qualified in Radiation Protection."
Contrary to this requirement, an individual not qualified in Radiation Protection, as defined in licensee procedures was the "leadman" on the following Radiation Work Permits (RWP).

Procedure RP-2, "Radiation Work Permit Procedure,"
states in Sections 4.7 that:
"The leadman then reviews each 6 Authorized Exposure to ensure that this remaining quarterly Authorization is large enough to allow receiving the exposure anticipated on the job. If it is not, then an increased authorization must be obtained, a dif-ferent person must be selected for the job, or the person must leave the job site when he receives the remaining authorized exposure.",
and in Section 5.9.states that:
"It is the responsibility of each individual to ensure, by frequently reading his dosimeter, that he does not exceed the h, Authorized Exposure entered on the RWP."
Contrary to this requirement, an individual exceeded his 6 Authorized exposure on April 24, 1979 while working under RWP 2822.
The indivi-dual entered the drywell at 7:30 PM with a b, Authorized Exposure of 55 mrem.
He exited the drywell at 10:30 PH and recorded a pocket dosimeter exposure of 160 mrem.
The individual was permitted to

reenter the drywell an hour and a half later and work until 2:50 AM, April 25, 1979.
During this entry, the individual accumulated an addi-tion 200 mrem without first obtaining an increased authorization.

Procedure RP-2, "Radiation Work Permit Procedure,"
states in Section 5.4, that, "...the leadman is responsible for familiarizing personnel with all the instructions on the permit, and insuring that these instructions are strictly followed...."
Contrary to this requirement, the following instructions that appeared on the RWPs noted below were not followed.

"Radiation Protection Procedure" states in Section III.F.3.l.bl that,.
"After laundry:
To be returned to use, clothing must be less than 4000 c/m as detected with a count rate meter or a portable gm detector."
Contrary to this requirement, on September 27, 1979, the inspector in the presence of the licensee's representative, using the licensee instrument (Victoreen Model 49, Serial No.
822 calibration due 12/20/79) observed that, of five pairs of anti-contamination coveralls returned to issue bins for use, each indicated levels of contamination from 5000 to 15000 c/m.
