This office has received a copy of your application for license amendment notarized on September 20,
- 1979, and transmitted by letter dated September 25, 1979 from LeBoeuf, Lamb, Leiby, 8 MacRae.
The application
.. was filed with the Office of Nuclear Reactor Regulation (ONRR) for review and approval of operation of the Nine Mile Point Nuclear Station Unit No.
1 with two inoperable recirculation loops.
Your application was not accompanied by a license amendment fee as required by 10 CFR 170.22.
Although you filed the September 25 application as a supplement to your July 18 application (which was approved on August 10, 1979 as Amendment No.
34 to License No. DPR-63), the ONRR staff has advised us that the N-2 loop opera-tion involves consideration of a safety issue.
As such, the September 25 application requires a Class III amendment fee of $4,000.
It is,requested that the Class III fee be forwarded to this office. If the final evaluation of your application by ONRR. staff reveals that this fee is incorrect, you will be refunded any overpayment or billed for any additional amount due.
