By letters dated March 15,

1994, and May 25, 1994, Pacific Gas and 'Electric Company (PG&E) requested an exemption from the technical requirements of Section III.J of Appendix R to Part 50 of Title 10 of the Code of Federal

Mr. Gregory M. Rueger April 4, 1997 In the letter to PGRE dated May 5, 1995, the NRC denied the requested deviation from Section III.J of Appendix R.

In the safety evaluation, the NRC stated that the underlying purpose and intent of Section III.J of Appendix R

is to provide fixed emergency lighting units of sufficient duration to eliminate the availability of a light 'source as an element requiring operator consideration when responding to a fire emergency that requires plant shutdown.

The alternative proposed by, the licensee did not satisfy this

~ 'purpose or intent.

The NRC prepared a request for additional information (RAI)- which was provided to the licensee in a letter dated December 12, 1996.

The NRC met with the licensee fire protection personnel on January 30, 1997, to -discuss fire protection issues.

At 'this meeting, the licensee presented their answers to the questions that the NRC has regarding emergency l.ighting issues.

The licensee submitted a written 'response to the RAI by letter dated February 7,

1997.

In. their response, the licensee'tated that emergency lighting (either 8-hour battery lights, emergency ac lights, or 'emergency dc lights) is provided in all areas where operator actions are'erformed

'and in access/egress routes thereto.

The emergency ac and dc lights are not fixed 8-hour battery lights,

however, the NRC approved a devi ation.to credit emergency ac and dc lighting for specific fire areas in Supplement Nos.. 23 and 31 of the PGKE Safety Evaluation Report (NUREG-0675).

On the basis of the information submitted, the licensee is'urrently in compliance with its commitment to meet Section III.J of Appendix R.

The licensee should maintain the supporting documentation for its"emergency lighting pro'gram onsite for future NRC audits or inspections.
