By letters dated March 15,

1994, and May 25, 1994, Pacific Gas and Electric Company (PG&E) requested an exemption from the technical requirements of Section III.J of Appendix R to Part 50 of Title 10 of the Code of Federal

Section III.J of Appendix R to 10 CFR Part 50 requires that emergency lighting units with at least 8-hour battery power supply be provided for the access and egress routes to all areas needed for the operation of safe shutdown equipment.

The licensee requested approval to use procedurally-controlled hand-held portable lights (flashlights) rather than fixed emergency lights for certain access and egress routes.

The staff treated the exemption request as a deviation from the licensee's commitment to meet Section III.J of Appendix R.

The exemption request is hereafter referred to as a "deviation request."

By letter dated May 5, 1995, the staff provided its safety evaluation.

On June 23,

1995, PG&E submitted Calculation No. 335-DC, Revision 2, "10 CFR Part 50, Appendix R Emergency Lighting and Communications."

The staff has reviewed the calculation and subsequent revisions of the calculation submitted on January ll, 1996 (Rev.

3) and May 24, 1996 (Rev. 4).

PG&E also submitted, at the staff's request, Appendix A of Calculation H-928, "Evaluation of Operator Access/Egress in Affected Fire Area" and Calculation M-944, "10 CFR 50 Appendix R, Alternate Shutdown Methodology - Time and Manpower Study/Safe Shutdown System Considerations."

These two calculations had also been revised and were referenced in Calculation No. 335-DC.

Page A-I of Appendix A to Calculation M-928 states "The availability of emergency lights is not guaranteed during transit into the area....Nevertheless, flashlights will be available for operators to use when performing the actions."

These statements are contrary to the licensee's commitment to meet Section III.J of Appendix R to 10 CFR Part 50 and the technical concerns documented in the aforementioned safety evaluation.

Therefore, clarification is needed as to what actions PG&E has taken in response to the denial of their deviation request dated March 15,
