AND NOTICE OF
VIOLATION
Dear Hr. Rueger:
An NRC inspection
was conducted July 7 through August 17,
1996, at your Diablo
Canyon Nuclear
Power Plant, Units
1 and
2 reactor facilities.
The enclosed
report presents
the scope
and results of that inspection.
During the inspection, period, your conduct of activities at the Diablo Canyon
facility was generally characterized
by safety conscious
operations
and good
maintenance
and engineering practices;
however,
one violation was identified.
The violation addresses
the failure to perform
a prompt operability assessment
following identification of a degraded
condition and circuitry different than
that specified
by the design.
This issue is of concern since it potentially
affected four of your six EDGs and your staff was slow to assess
its impact on
the'EDGs'bility to perform their design function.
The violati.on is cited in the enclosed
Notice of ViolatIon (Notice) and the
circumstances
surrounding the violations are described in detail in the
enclosed
report.
Please
note that you are required to respond to this letter
and should follow the instructions specified in the enclosed
Notice when
preparing your response.
The
NRC will use your response,
in part, to
determine whether further enforcement
action is necessary
to ensure
compliance
with regulatory requirements.
In accordance
with 10 CFR 2.790 of the
NRC's "Rules of Practice."
a copy of
this letter, its enclosure(s),
and your response will be placed in the
NRC
Public Document
Room (PDR).
To the extent possible,
