Dear Hr. Rueger:

The Commission's regulations, specifically, 10 CFR 50.59, authorize licensees to make changes in the facility as described in the safety analysis report, without prior approval, unless the proposed change involves a change in the technical specifications incorporated in the license or an unreviewed safety question.

By letter dated January 27, 1997.

you informed the NRC of your intention to initiate an auxiliary saltwater (ASW) piping bypass project due to a concern that localized corrosion was occurring in the portion of the piping buried below sea level in the tidal zone outside the intake structure.

You performed a 10 CFR 50.59 review and determined that this project did not involve an unreviewed safety question.

You provided a copy of your 50.59 evaluation in the January 27, 1997 letter.

Due to the complexity of the modification, a

meeting was held on March 25.

and a request for additional information was sent to you on April 4, 1997.

By letter dated Hay 15, 1997, you responded to the request for additional information.

It is solely the licensees'esponsibility to make determinations as to whether a change to their facilities would involve an unreviewed safety

evertheless, because of'he=staff's interest in the ASW piping bypass project at Diablo Canyon, the staff reviewed the technical basis for your conclusions provided in your January 27.

During a telephone conversation held on August 13.

1997. the NRC informed your staff that it was the staff's position that an unreviewed safety question existed.

The Diablo Canyon Final Safety Analysis Report (FSAR) classifies the ASW system as Seismic Category I.

The FSAR does not indicate any provssion for the siting of Seismic Category I structures.

systems, or components (SSC) on liquefiable materials.

In fact. according to the FSAR.'all Category I SSC are found on rock or on concrete fill: Also. the FSAR describes the ASW piping as being anchored in concrete to the circulating water conduits at 40-foot intervals.

indicates a high probability of liqu'efaction of material under the ASW pipeline over a portion of the bypass route.

The NRC does not agree with this statement, in that due to the
