This refers to the inspection

conducted

by Mr.

W. Schaefer of this office

on January

8-12,

1996, at the Diablo Canyon Nuclear

Power Plant,

Units

1 and

2. facility.

The purpose of the inspection

was to determine

whether

activities authorized

by the license were conducted safely and in accordance

with NRC requirements.

At the conclusion of the onsite inspection.

the

findings were discussed

with those

members of your staff identified in the

enclosed

report.

A followup telephone

discussion

was also conducted

between

Messrs.

W.

Ryan

and

D. Sisk of your staff and Mr. Schaefer

on January

to clarify certain inspection findings.

This inspection also involved

an in-office review of your audit report of the Westinghouse

access

authorization

program,

dated February

29.

1996.

Your staff provided

a copy of

this audit report on March 21.

1996.

and our review of this report was

completed

on March 29 '996.

A followup telephone exit meeting

was held on

April 5.

1996,

between

Messrs.

B. Murray and

D. Schaefer of this office and

those

members of your staff identified in the enclosed

report. to inform you

of our disposition of the inspection results.

The purpose of this inspection

was to review Licensee

Event Report 95-S02-00.

dated

November

1995.

Areas

examined during the inspection are identified

in the report.

Within these areas'he

inspection consisted of selective

examinations of procedures

and representative

records'nterviews

with

personnel'nd

observation of activities in progress.

Based

on the results of this inspection,

one apparent violation was identified

and is being considered

for escalated

enforcement

action in accordance

with

the "General

Statement of Policy and Procedure for NRC Enforcement Actions"

(Enforcement Policy),

NUREG-1600.

This apparent violation involved your

failure to review and evaluate all pertinent

background information developed

during an access

authorization investigation before granting

an individual

unescorted

access.

Consequently,

an individual who should not have

been

granted

access

obtained

unescorted

access

authorization to Diablo Canyon

contrary to the requi rements of 10 CFR 73.56

and your Security Plan.

Additionally. this apparent violation led to the identification of weaknesses

in your access

authorization

program.

and in the Westinghouse

Electric

Corporation.

The ci rcumstances

surrounding this apparent violation, the significance of the

issues,

and the need for effective long-term corrective actions

were discussed

with members of your staff during the inspection

and at the inspection exit

meeting

on January

12,

1996.

As

a result, it may not be necessary

to conduct

a predecisional

enforcement

conference

in order to enable the

NRC to make

an

enforcement decision.

However.

a Notice of Violation is not presently being

issued for these

inspection findings.

Before the

NRC makes its enforcement

decision.

we are providing you an opportunity to either

(1) respond to the

apparent violation addressed

in this inspection report within 30 days of the

date of this letter. or (2) request

a predecisional

enforcement

conference

within 7 days of the date of this letter

.

Your response

should

be clearly marked

as

a

"Response to an Apparent Violation

in Inspection

Report, 50-275/96-01,

and should include:

(1) the

reason for the apparent violation. or, if contested'he

basis for disputing

the apparent violation, (2) the corrective steps that have
