AND NOTICE OF
VIOLATION
This refers to the inspection
conducted
by H. Tschiltz and
G. Johnston of this
office on April
2 through
Hay 13,
1995.
The inspection
included
a review of
activities authorized
for your Diablo Canyon Nuclear
Power Plant,
Units
1
and
2, facility.
At the conclusion of the inspection,
the findings were discussed
with those
members of your staff identified in the enclosed
report.
Areas
examined during the inspection
are identified in the report.
Within
~
~
these
areas,
the inspection consisted
of selective
examinations of procedures
and representative
records,
interviews with personnel,
and observation of
activities in progress.
The purpose of the inspection
was to determine
whether activities authorized
by the license
were conducted
safely
and in
accordance
with NRC requirements.
Based
on the results of this inspection,
certain licensed activities appeared
to be in violation of NRC requirements,
as specified in the enclosed
Notice of
Violation.
The violation is of concern
because it involved maintenance
that
affected the performance of the emergency
diesel
generators
(EDGs).
The
preplanning
and work controls utilized for the repair of pyrocrete failed to
properly consider the potential effect of scaffolding
and tenting
on
radiator cooling air flow.
The initial engineering
evaluations
of the
significance of the air flow reduction
based
upon engineering
judgment were
incorrect.
After the significance of the air flow reduction
was recognized,
a
detailed analysis
was required to determine
the past operability of Unit
1
EDGs.
Following identification of the problem during the work on Unit 1, the
corrective actions
taken failed to prevent
a similar problem with blockage of
EDG 2-2 radiator air flow during pyrocrete repairs
performed
on Unit 2.
One noncited violation was also identified.
The violation involved the
failure to perform required testing of containment
emergency airlock door
seals.
This violation is not being cited because
the criteria in
paragraph
VII.B.2 of Appendix
C to
10 CFR Part 2 of the
NRC's "Rules of
Practice"
were satisfied.
Additionally, this report documents
a number of instances
where your staff had
not displayed
a questioning attitude or had not adequately
followed through to
'orrect identified deficiencies.
These
examples
represent
a departure
from

the very strong
performance that
we have recognized
previously.
I encourage
you
and your staff to assess
these
examples for common 'cause.
You are required to respond
to this letter
and should follow the instructions
specified
in the enclosed
Notice when preparing your response.
In your
response,
you should
document
the specific actions
taken
and
any additional
actions
you plan to prevent recurrence
of the
EDG violation.
Your response
may reference
or include previous docketed
correspondence, if the
correspondence
adequately
addresses
the required response.
After reviewing
your response
to this Notice, including your proposed corrective actions
and
the results of future inspections,
the
NRC will determine
whether further
NRC
enforcement
action is necessary
to ensure
compliance with NRC regulatory
requirements.
In accordance
with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of
this letter, its enclosure(s),
and your response will be placed in the
NRC
Public Document
Room (PDR).
To the extent possible,
your response
should not
include
any personal
privacy, proprietary,
or safeguards
information so that
it can
be placed in the
PDR without redaction.
However, if you find it
necessary
to include such information, you should clearly indicate the
specific information that you desire
not to be placed in the
PDR and provide
the legal basis to support your request for withholding the information from
the public.
The responses
directed
by this letter
and the enclosed
Notice are not subject
to the clearance
procedures
of the Office of Management
and Budget
as required
by the Paperwork
Reduction Act of 1980,
