I am pleased to respond to your letter dated May 11, 1979 to'the Chairman of the Nuclear Regulatory Corrroission (NRC), in which you commented on Governor Bro>>n's letter of May 4, 1979 to the Chairman.
Since it would not be appro-priate'under current Corrcnission rules for the Chairman to comment on your
.I letter,.jt was referred to me for reply.
In your letter, you expressed concern over Governor Brown' request for a moratorium on the issuance of an operating license for the Diablo Canyon Nuclear Po>>er Plant.
C As you knovi, the NC staff is currently conducting a thorough investigation of the accident at the Three Mile Island plant.
Thss investigation includes study of potential design deficiencies in the plant, plant operator response to the accident, including operator errors and/or misinterpretation of plant instru-mentation, and all other aspects of the accident which might lead to information
~
that would improve the safety of nuclear po>>er plants.
The results of the staff's I
investigations will also be applied, among others, to plants that are currently under construction and have applications for an operating license, such as the Diablo Canyon plant; New safety requirements arising from these-investigations will be applied to the Diab'lo Canyon plant to the extent that they are applicable.
j While we regret any hardship that this may impose on the Pacific Gas
& Electric
- Company, we believe it. is justified in terms of the continued pr'otection of the health and safety of -the general public.

I As you may know, several members of your staff will be attending a meeting at the Commission's Bethesda office on Jufie 13, 1979, along with other utilities that currently have nuclear power plant licensing applications under review by the staff.
The subject matter of these meetings will be related to the effects of the Three Nile Island Unit 2 evaluation on the licensing reviews of plants like Diablo Canyon.
This meeting should provide an opportunity to discuss some of the questions that the Pacific Gas and Electric Company may have on this matter.
