DOCUMENT CONTAINS SAFEGUARDS INFORMATION ENCLOSURE 1 NOTICE OF VIOLATION Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant Docket Nos.:

50-275 50-323 License Nos.: DPR-80 DPR-82 During an NRC inspection conducted on November 16-19, 1998, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

License Condition 2.E of the Diablo Canyon Nuclear Power Plant Facility Operating License No. DPR-80 dated October 17, 1988, requires that the licensee fullyimplement and maintain in effect the Commission approved physical security plan, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p).

Appendix B, paragraphs A and E to 10 CFR Part 73 requires that each individual who requires training to performed assigned security-related job tasks willbe trained and annually requalified.

Paragraph 1.2.8 of the physical security plan states that plant staff assigned security related functions such as inspecting and/or searching packages and incoming materials are trained in applicable security procedures.

Paragraph 2.1 of the training and qualification plan requires that the training program include annual requalification.

Contrary to the above, on November 19, 1998, the NRC inspector identified that two warehouse personnel assigned duties to inspect and search incoming packages and incoming material at the warehouse had not received annual requalification training since, 1996.

This is a Severity Level IVviolation (Supplement III) (50-275;-323/9819-01).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance willbe achieved is already adequately addressed on the docket in the attached report.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 ifthe description therein does not accurately reflect your corrective actions or your position.

Ifyou contest this enforcement action, you should also provide a copy of your response with the basis for your denial, to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

Therefore, ifyou choose to respond, your response will be placed in the NRC Public Document Room (PDR). To the extent possible, the response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information.
