M74816, H74817, H76110 AND H76111)

By a letter dated November 2,

1990, you submitted request for "Temporary Deferral of Review," for license amendment requests (LARs) 89-11, 90-01, and 90-06 to the Diablo Canyon, Units 1 and 2, Facility Operating License Nos.

DPR-80 and DPR-82, respectively.

Specifically, the license amendment requests were (1)

LAR 89-11,

" Increase Safety Valve Setpoints Tolerances,"

(2)

LAR 90-01, "Operation With One Pressurizer Safety Valve Inoperable and Disabled,"

and (3)

LAR 90-06, "Operation with Unit 2 Pressurizer Safety Valve Inoperable and Disabled."

LAR 89-11 and LAR 90-01 were noticed in the Federal Re ister on September 6,

1989, and October 4, 1989.

Subsequently, during discussions with your staff, it was agreed that the NRC staff review of these three issues should be terminated and that any future license amendment requests related to safety valves would be processed by the NRC staff as new amendment requests.

We documented this in a letter dated December 21,

1990, and and stated that we would consider the proposed amendment requests published in the Federal

~ne ister to be withdrawn unless you notified us that our understanding was incorrect.

Since you have not responded, we consider amendment requests LAR 89-11 and LAR 90-01 withdrawn.

LAR 90-06 was not noticed in the Federal

~Re ister and thus need not be formally withdrawn.
