This will acknowledge receipt of your letter dated Harch 12, 1990 and your check for $50,000 in payment for the civil penalty proposed by the NRC in a letter dated February 13, 1990.
lie note that PGIlE acknowledged that the sump access hatches were opened at various times on both units during power operation, but concluded that that action did not render the containment recirculation sump inoperable as stated in Violation B.
Rather, your response stated that an inadequate safety evaluation had been performed for the temporary procedure used to open the hatches, and went on to address the corrective steps taken.
The first step indicated that if management determines that opening the hatch at power is acceptable, concurrence will be sought from the NRC resident inspector.
lie disagree with that statement and wish to emphasize that should you determine that there is a need to open those hatches in excess of the one hour time limit specified in Technical Specification 3.0.3, prior NRC concurrence through either a technical specification change or waiver of compliance is needed, absent a 10 CFR 50.54(x) determination.
Your corrective actions will be examined during future inspections.
