On November 3, 1981 a meeting was held at Bethesda, Maryland, in which representatives of Pacific Gas and Electric Company (PGSE) attended.

This meeting was a continuing discussion of the seismic design problems at the Diablo Canyon Nuclear Power Plant and in particular the seismic reverification program being conducted by R. L. Cloud Associates, Inc. (Cloud Associates).

During this meeting, as a result of questions raised by the Nuclear Regulatory Commission (NRC) Staff, PGIEE representatives made responses which led the NRC Staff to believe that written reports dealing with the reverification program being conducted by Cloud Associates had not been provided to PG&E prior to the November 3, 1981 meeting.

However, in fact, draft reports had been prepared by Cloud Associates and had been submitted to PGItE for comments on October 21, 1981 and October 26, 1981.

The NRC Staff has conducted an investigation into the circumstances surrounding the existence of the October draft reports and the statements made by PGSE concerning them at the November 3, 1981 meeting.

We have concluded that a

false statement was made during this meeting by senior representatives from PGSE.

We have also concluded that the false statement is material.

It is material because the independence of the reverification program was a matter of concern to the NRC Staff during the November meeting and had the NRC Staff been aware that draft reports had been circulated for comment, the NRC Staff would have requested submission of such reports together with the comments in order to evaluate the independence of the program.

Therefore, we have concluded that a material false statement by omission was made.

We have categorized the material false statement as a Severity Level III violation and have enclosed a Notice of Violation.

Pacific Gas and Electric Company 4 FEB I 1 39B2 We are particularly concerned that certain management personnel of PG&E at the November 3, 1981 meeting had knowledge of the inaccurate statements but did not correct the omission either during or after the meeting.

Candor between the NRC and its licensees is fundamental to the relationship between a licensee and the NRC.

Anything less than an honest and open exchange of information between NRC and its licensees cannot and will not be tolerated.

Therefore, the Chairman of the Board of PG&E is requested to meet with me and the Regional Administrator of Region V to discuss steps that will be taken by PG&E to assure that communications between it and NRC are complete and accurate and that employees at all levels within PG&E and also its consultants and contractors clearly understand that nothing less is acceptable.

This meeting will be held at an NRC office at a mutually convenient time but no later than 30 days from the date of this letter.

In accordance with Section 2.790 of the NRC's "Rules of Practice,"

Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC Public Document Room.

The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget, as required by the Paperwork Reduction Act of 1980, PL 96-511.
