submiitted your proposed design verification prograri> - Phase II'nd the cations of Stone 8 Hebster as an additional independent contractor to participate in the Phase II program.

You also requested a single comment period of 15 days on your Phase II submittal.

As you are aware, the Commiission stipulated 'in its Order dated December 23, 1981 that the period for comments on the choice of companies and on your reverification program plan for Phase I as proposed in your submittal of December 4, 1981 should be extended until one week after a staff repor t on the investigation of the independence of Dre R. L. Cloud has been placed in the Public Document Room in Iiashington, D.C.

As you are also aware, the Commission has not yet reached a decision on this issue.

Phase I of the staff report has been recently placed in the PDR.

Phase II of the staff report has not yet been completed.

In addition, the staff has recently identified several concerns to you regarding your Phase I program.

(See January 8, 1982 Meeting Agenda items and letter from D. G. Eisenhut to M. H. Furbush dated January

, 1982).

Sincerely; In recognition of these circumstances, we have determined that the comment period for your Phase II submittal of January 13, 1982 should not start earlier than the date the comri~ent period on Phase I ends nor later than the Commission's decision regarding the qualifications and independence of your Phase I contractors and approval of your Phase I program.
