By application dated August, 21, 1980, your Company requested that the Office of Nuclear Reactor Regulation extend the latest completion dates of the con-struction permits for Unit Nos.

1 and 2 of the Diablo Canyon Nuclear Power Plant.

Fees totalling $1,600 for Classes II and I were remitted with this application pursuant to 10 CFR 170.22.

Based on information provided by the ONRR staff, it has been determined that the portion of your August 21, 1980 application relating to Unit No.

1 is ex-empt from the fee requirements of 10 CFR 170 since no review had commenced on it prior to the issuance of License Ho. DPR-76 for Unit Ho.

1 on Septem-ber 22, 1981.

On this basis.

we have concluded that an exemption, pursuant to 10 CFR 170.11(b),

from the fee requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for that portion of the August 21, 1980 application relating to Unit 1.

Therefore, a

refund is appropriate for a portion of the fees that your Company paid.

Since the August 21 application now only involves a single unit (Ho. 2) and

,is still pending review with the USHRC, we are retaining

$1,200 (of the 41.600 which your Company paid) for the Unit,No. 2 extension and refunding the duplicate Class I fee of $400.

Therefore, we are concurrently authoriz-ing the Division of Accounting and Finance to refund a sum of $400 to your Company.

Refunds are generally processed in approximately two weeks.

If the ONRR staff's final review of the August 21, 1980 application revea'Is that the Class II fee is not correct for Unit Ho. 2, you will be notified and any necessary adjustments will be made.
