By application dated December 29, 1981, your Company requested that the Office of Nuclear Reactor Regulation (ONRR) extend the imp'lementation dates for five items in License Ho. DPR-76 for the Diablo Canyon Nuclear Power Station Unit Ho. 1.
With this application, you" remitted a total of $20,000 to cover five C'lass III fees pursuant to 10 CFR 170.22.
In response to your application, the OHRR staff issued Amendment Ho.
1 to License No.
DPR-76 on February 5.
1982, which was preceded by a letter of approval dated December 31, 1981.
Based on the ONRR staff's final review of your application, it has been determined that a single Class II fee of $1,200 is appropriate in lieu of the five Class III fees.
The review was considered to be administrative in nature in view of the status of the plant and license.

In consideration of the above, we have concurrently authorized the Office of the Controller to refund a sum of $18,800 to your Company.
